Terms of Service

Using the Service

By creating an account or buying a ticket, registering as a vendor, or making a donation through the Service, you agree to these terms. You must be able to form a binding contract to use it.

Organizer accounts

Organizers are responsible for their events, the accuracy of their listings, fulfilling what they sell (tickets, booths, sponsorships), their tax obligations, and complying with the laws that apply to their events. The Service is a tool: we do not run, staff, supervise or insure anyone's event.

Who you are buying from

Once an organizer has connected their own Stripe account, their sales are charged directly on it: that organizer is the merchant of record, receives the money, and owns refunds and chargebacks for those sales. Two situations work differently, and you should know which one you are in - the receipt names the seller either way. Before an organizer finishes connecting Stripe, their sales are charged on our platform account. And for a shared "co-lab" night run by several organizers together, payment is pooled on our platform account on purpose and split between them after the event. In both of those cases we are the merchant of record for that payment and we do hold the funds until they are paid out.

Payments and fees

Card payments are processed by Stripe under its own terms. The platform charges a per-transaction service fee, disclosed at checkout and on the organizer's billing page before you pay (card processing is included in it; donations to verified nonprofits carry no platform fee; service fees are non-refundable). Whether the buyer or the organizer funds that fee is the organizer's choice, and the checkout shows the resulting total either way. There is no subscription and no charge for use of the Service itself.

Acceptable use

Don’t use the Service for anything unlawful, to misrepresent an event, to sell something you cannot deliver, to send messages without the recipient’s consent, or in a way that harms the Service or other users.

Suspension and removal

We may remove a listing or suspend an account that appears to break these terms, to be fraudulent, or to put buyers at risk - including while we look into a report. Where we can, we will say why and give you a chance to respond first; where money or safety is at stake we may act immediately. Suspension does not relieve an organizer of obligations to people who already bought from them.

Chargebacks

When an organizer is the merchant of record (the normal case), a disputed card payment is theirs: the amount and any bank fee come out of their Stripe account, and they choose whether to contest it. We give them the order record to do so. Where we are the merchant of record - an organizer who has not connected Stripe yet, or a pooled co-lab night - we handle the dispute and may recover the amount from money otherwise owed to that organizer.

Disclaimers and liability

The Service is provided “as is.” We are not responsible for an organizer’s event - whether it happens, what it is like, or what occurs there. To the extent permitted by law we are not liable for indirect or consequential damages, and our total liability is capped: to an organizer, at the platform service fees collected on their transactions in the prior 12 months (regardless of whether the organizer or their buyers funded those fees); to a buyer, at the amount you paid on the transaction the claim is about. Nothing here limits liability that cannot be limited by law.
